Description: ANDREW SPERBER, ESQUIRE will speak about the "Current Challenges for the Paralegal in Today's Electronic World" which will address the challenges of Florida’s e-filing system that is currently scheduled for full implementation by late 2013. Time will also be spent reviewing the Florida Supreme Court’s acceptance of seven procedural rule changes to Rule 1.200 (Pre-Trial Procedure) and 1.201 (Complex Litigation)relating to new rules governing e-discovery. The seminar will end with the challenges posed by Florida’s new service rules requiring service by Email mandatory as of September 1, 2012. JOAN M. LEVIT, ESQUIRE of Akerman Senterfitt will give an "Overview of Bankruptcy Matters" which will provide an overview of Chapter 7, 13 and 11 bankruptcy cases, specifically which case is appropriate for individuals and business. We will review the purpose of the meeting of creditors, types of property hat are exempt from creditors, circumstances where a debtor is not entitled to a discharge, the automatic stay and the penalties for violating the stay. We will cover topics including the priority of payment of claims, and the recovery of fraudulent or preferential transfers. If time permits we will provide an overview of plans of reorganization and the effect of confirmation of a plan. Each of the topics will include an explanation of the function of a paralegal working on a bankruptcy case, specifically in gathering information and preparing the petition, proof of claim, fee applications and other court papers. Description: Claims of ADA violations filed with the EEOC have risen significantly in the last four years. The ADAAA’s expanded definition of who is “disabled” will likely result in this trend continuing. This reality means that knowing how to correctly manage the interactive and reasonable accommodations process is critical.
Examine case studies culled from actual situations dealing with four key phases of the ADA compliance process:
• Accommodations in the hiring process
• Direct threat or abusive behavior caused by a disability
